These Terms do not apply to websites or services governed by separate terms or agreements, including franchisees of Purple Care. In case of any conflict between these Terms and your Service Agreement, the Service Agreement shall prevail.

Service Agreement Priority

If you have entered into a separate Service Agreement with Purple Care for specific services, those terms take precedence in the event of a conflict with these Terms.

General Provisions

These Terms, along with our Privacy Policy and any other supplemental terms or policies provided by Purple Care, form the legally binding agreement between you and Purple Care.

Purple Care reserves the right to modify these Terms at its discretion, with or without notice. Changes become effective immediately upon posting to the Site. You are encouraged to review these Terms regularly.

Jurisdiction and Governing Law

Payment Terms and Prepayment Plans

1. General Payment Terms: Payments can be made via the Site or other approved methods. All payments are subject to applicable taxes and fees.
2. Prepayment Plans: If you opt for a prepayment plan, your account will automatically convert to ongoing status once funds are depleted unless you contact us to cancel services.
3. Auto-Renewal Authorization: By enrolling in auto-renewal, you authorize Purple Care to charge your payment method for future services until cancellation.

Cancellation Policy

Services may be canceled by contacting Purple Care via [PHONE/EMAIL]. Depending on the timing and type of cancellation, fees may apply as detailed in your Service Agreement.

Disclaimer of Warranties

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. Purple Care makes no guarantees regarding the accuracy, reliability, or availability of the Site and disclaims all warranties, express or implied, to the fullest extent permitted by law.

Purple Care does not guarantee uninterrupted or error-free service and is not responsible for issues beyond its control, such as network disruptions or third-party actions.

Limitation of Liability

To the fullest extent permitted by law:

• Purple Care shall not be liable for indirect, incidental, punitive, or consequential damages, including but not limited to loss of data or profits.
• Purple Care’s total liability for any claim shall not exceed the amount you paid to Purple Care in the three months preceding the incident or $50, whichever is greater.

Dispute Resolution and Arbitration

You and Purple Care agree to resolve all disputes through binding arbitration administered by [ARBITRATION BODY] under its applicable rules.

• Class Action Waiver: Claims must be brought individually, and neither party shall participate in class or collective actions.
• Exceptions: Claims eligible for small claims court are exempt from arbitration.

Digital Content Submissions

Mobile Application Usage

If Purple Care offers a mobile application, usage is subject to these Terms. Access and functionality may vary based on your device, provider, and location. Purple Care does not guarantee compatibility with all devices.

Marketing Communications

By providing your contact information, you consent to receive marketing communications. You may opt-out by:

• Replying “STOP” to SMS messages.
• Unsubscribing via the link in emails.
• Contacting Purple Care customer service.
  

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

Termination of Use

Purple Care reserves the right to suspend or terminate your access to the Site or services at its sole discretion for any violation of these Terms.

Indemnity

You agree to indemnify and hold Purple Care harmless from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Site.

Entire Agreement

These Terms, along with our Privacy Policy and any other supplemental terms, constitute the entire agreement between you and Purple Care regarding the use of the Site and services.
